This Privacy Policy ("Policy") is the document that demonstrates the commitment of MUNDIAL S.A - CONSUMER PRODUCTS, private legal entity, with head office at (Rua do Paraíso, 148, 14º andar, cj. 142, Paraíso, CEP 04103-000, São Paulo/SP), enrolled with the National Register of Legal Entities (CNPJ) under no. 88.610.191/0001-54, and of all the companies in which it has direct or indirect ownership interest, with the privacy and protection of its information.

We, from Mundial are committed to privacy and protection of our customers and partners personal data. Therefore, we present this Privacy Policy to explain how we collect and use personal data, in addition to informing you of your rights, guaranteed by the General Law of Data Protection, and how to exercise them.

We are constantly working to improve our content and navigation. For this reason, our Policy may undergo updates to reflect the improvements made. We therefore recommend that you visit this page from time to time so that you are aware of any changes made.

GLOSSARY


Anonymization: Is the use of reasonable and available technical means at the time of processing, by which a data loses the possibility of association, direct or indirect, to an individual.

National Data Protection Authority (Autoridade Nacional de Proteção de Dados - ANPD): Federal Government body responsible for overseeing and supervising compliance with the General Law on Personal Data Protection.

Legal Bases: The legal bases that authorize the processing of personal data by Mundial. For example: your consent, the need to fulfill a legal obligation or a contract we have with you.

Cookies: Small files sent by websites, saved in your device, that store your browsing preferences and few other information, with the purpose of personalizing browsing according to your profile.

Personal data: Information related to an individual that allows him/her to be identified or makes it possible for him/her to be identified. For example: name, ID number, date of birth, telephone, e-mail, professional information, IP address, geolocation, etc.

Personal Data Officer: This is the person appointed by us to act as a communication channel between you, Mundial and the National Data Protection Authority.

IP Address: Abbreviation for "Internet Protocol." It is the set of numbers and letters that identifies the device used by you to access our sites.

Applicable Legislation: It is the legislation on privacy and protection of personal data applicable to the activities of Mundial, especially in relation to the terms of Law No. 13,709/18 (LGPD).

Brands: Are the brands of Mundial, existing or that come to exist. Currently, we have the following brands: Mundial, Impala, Hercules, Eberle, and Syllent.

Platforms: Websites managed by or for Mundial and its brands.

Holder of Personal Data: The natural person to whom the personal data subject to processing refer, in this case, you.

Processing: It is any operation performed with personal data, such as, for example, collection, classification, access, use, sharing, transmission, classification, processing, storage, deletion, evaluation, modification, etc.

You: Is the Holder of the personal data that relates to us, whether as a customer or partner.

Mundial collects personal data in several ways, physically or virtually, always according to the reason and the relationship you have with us.

Mundial processes personal data, in accordance with LGPD, for the purposes intended at the time of collection or contained in this privacy policy.

You are solely responsible for the accuracy, veracity or updating of the personal data you provide us. We are not obliged to process your personal data if there is reason to believe that such processing could impute to us a breach of any applicable law.


2) WITH WHOM IS YOUR PERSONAL DATA SHARED?


We may share personal data in the following situations, through secure processes and respecting the confidentiality of the information to the maximum extent possible:

With internal areas and other companies of Mundial;

With service providers or partner companies to facilitate, provide, or perform activities related to the products or services we offer, including, for example, merchants, billing and delivery companies, and server hosting companies

With marketing and advertising companies, to deliver to your promotions and information tailored to your profile;

With public authorities, whenever there is a legal determination, requirement, requisition, or judicial/administrative order to that effect; and

With eventual companies in case of corporate restructuring, incorporation, or merger of Mundial.

We provide the option to register and access our e-commerce platforms with your Facebook login. In this case, certain personal data may be shared with this third party. You can always decide whether or not to integrate this information. We do not control the policies and practices of any other third-party sites or mechanisms.

Whenever sharing outside of the above situations is necessary, we will inform you at the time of collection of the personal data.


3) INTERNATIONAL TRANSFER OF PERSONAL DATA


Mundial is based in Brazil, however, we may subcontract to companies located or that process personal data in other countries. In this case, we will give preference that this transfer occurs only to countries that have a similar level of security to the one provided by the Brazilian legislation, or when the National Authority for Personal Data Protection so authorizes.

If this is not possible, we will use appropriate contractual clauses to ensure that Third Parties receiving your personal data comply with the protection standards of the GDPR, as well as with the obligations contained in this policy.

Listed below are some circumstances in which we may perform international transfers of personal data:

Upon your authorization;

To comply with legal or regulatory obligations;

If it is necessary for (i) international legal cooperation between public intelligence, investigative and prosecutorial bodies, in accordance with the instruments of international law; (ii) the protection of the life or physical integrity of you or a third party; (iii) the proper execution of a contract established with you; or (iv) the execution of a public policy or the lawful assignment of a public service;

When authorized by national authority; or

When the transfer is made to countries whose privacy legislation ensures an adequate degree of protection of personal data in accordance with the LGPD.


4) TIME OF STORAGE OF PERSONAL DATA


We store personal data only for the period necessary to fulfill the purposes stated, to comply with our legal or regulatory obligations, or to preserve rights. After the storage period has expired, personal data will be anonymized or deleted using a secure method of disposal.

You may at any time request the deletion of your personal data.

However, because of our legal obligations, we cannot delete your personal data immediately. Should this be the case, you will be informed of this impossibility and your personal data will be deleted at the end of the legal period.


5) YOUR RIGHTS


You, as the Holder of the personal data, have the following rights guaranteed by the LGPD:

Access - You may request a copy of the personal data we hold about you.

Correction - You may correct your outdated, incomplete, or incorrect personal data.

Portability - You have the right to request that the personal data we process to be transferred to another service provider, in the same industry as Mundial, that you designate.

Elimination - It is the right to have your personal data eliminated from our databases, except in the case of the legal storage hypothesis.

Anonymization or blocking - It is the right to request that personal data be submitted to anonymization or blocking, suspending temporarily the treatment.

Withdrawal - You have the right to refuse or withdraw your consent and obtain information about the consequences of this choice. In this case, some of the services may not be provided.

Information about sharing - You have the right to know with which public and private entities we share your personal data.

Objection - You may object to processing activities that do not depend on consent. In this case, you can request that we stop it.

Confirmation of processing - You have the right to confirm whether we have processed any of your personal data.

We apply procedural, technical, and physical measures to help prevent the loss, misuse, or unauthorized access, disclosure, alteration, or destruction of personal data.

However, it is possible that third parties beyond our control may unlawfully intercept or access transmissions or personal data.

You are also responsible for the secrecy of your personal data and should be aware that sharing passwords and access data violates this Policy and may compromise the security of your personal data and the sites.

When you browse our websites, you may access third-party pages or platforms, which may collect your personal data and have their own privacy policy.
