ONLINE CONSENT TERM FOR PROCESSING PERSONAL DATA SUBMISSION OF RESUMES

The present Term aims to register the express, free and unequivocal consent of the personal data informed by the APPLICANT (hereinafter referred to as "APPLICANT") by MUNDIAL SA - CONSUMER PRODUCTS, a legal entity governed by private law, headquartered at Rua do Paraíso, 148, 14º andar, cj. 142, Paraíso, Zip code 04103-000, São Paulo/SP, registered with CNPJ under no. 88.610.191/0001-54, and of all companies in which it directly or indirectly holds equity interest (hereinafter referred to as “MUNDIAL”), with the objective of protecting the fundamental rights of freedom and privacy and the free development of the personality of the natural person, under the terms of Law No. 13.709/2018 – General Personal Data Protection Law (LGPD).


The APPLICANT accepts and agrees that MUNDIAL uses, for the specific purposes of receiving curriculum, evaluation and selection, in eventual recruitment to participate in the process of admission into its staff, the personal, academic, professional and sensitive data provided in the admission process of PWD job vacancies.

The APPLICANT authorizes that the curriculum and the registered information be stored in a database for a period of 02 (two) years, in case hiring does not occur.


This present consent may be revoked at any time upon express manifestation of the APPLICANT, ratifying the treatments carried out under the protection of the consent previously manifested.


The request for revocation of this term must be made at MUNDIAL'S privacy center through the privacy options button located on the lower left side of MUNDIAL'S webpages.


After the period of 02 (two) years, without hiring, or even in the case of revocation of the Consent Term, there will be the termination of the processing of data by MUNDIAL, with the elimination of data stored in its database, except for the cases in which by legal and regulatory obligations, including those provided for in art. 7 and 11 of Law No. 13.709/2018 - General Personal Data Protection Law (LGPD), MUNDIAL should maintain it.


In the case of hiring the APPLICANT, the data collected will remain stored in the database of MUNDIAL, and will be treated in accordance with one of the authorizing hypotheses of the General Personal Data Protection Law.

1. INFORMATION ABOUT THE WEBSITES


1.1 The websites were created to allow the user to contact us; enable the application for a job opportunity in Mundial; facilitate access to bills and invoices of our customers; enable the online sale of products, present corporate, financial information and about the products of Mundial's brands and/or licensed by it, to the interested public.

1.1.1 The websites and their functionalities are presented to the user in the manner in which they are available and may undergo constant improvements and updates.

1.2 Mundial applies its efforts for the continuous and permanent availability of the sites, being subject to extraordinary events such as natural disasters, failures, or collapses in the central communication and internet access systems or third-party events, which are beyond our control and responsibility.

1.2.1 The user has no right to demand the availability of the sites and may not claim compensation or damages in case the sites remain offline, regardless of the reason.


2. USE OF THE WEBSITES


2.1. The user undertakes to use the sites only for the purposes presented herein, with ethical rectitude, always respecting the legislation in force and the Terms of Use, and being responsible for all losses and damages caused.

2.2 The user is forbidden to access the programming areas of the sites, their databases, source codes, or any other set of data available in these environments, as well as not to perform or allow reverse engineering, nor to translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute or otherwise inappropriately dispose of the functionalities of the sites.

3. CONTENT AND INTELLECTUAL PROPERTY


3.1 All news, images, videos, catalogs, and trademarks made available on the site in any language or form are the exclusive property of Mundial or licensed to Mundial. Use of the site does not create any presumption of transfer of such ownership or license.

3.1.1 The brands displayed on the sites are registered and/or licensed property of Mundial and cannot be reproduced without the express authorization of the company. Reproduction of the content made available (photographs, videos, catalogs, etc.) is prohibited, except with prior written authorization from Mundial or if intended for exclusively personal use, without the user acquiring any right over them.

3.1.2. The user is aware that unauthorized commercial use may result in civil and criminal offenses.

3.2 The user assumes any and all responsibility, civil and/or criminal, for the improper use of information, text, graphics, brands, works, images, in short, any and all intellectual property rights available on the sites.


4. REGISTRATION OF USERS ON THE WEBSITE


4.1 To use the exclusive features or make a purchase, the user must register on the Mundial website, provide personal data as required and adopt a strong password for identification.

4.2. Registration on the Portal is free and can be performed by individuals over 18 years old only.

4.3 When a company registers in the Portal, its Representative must be an individual over 18 years old.

4.4 When the USER is registered in this Portal, he/she must provide only true and faithful information, committing him/herself, from then on, to keep his/her data always updated, under the penalty of civil and criminal liability as well as being liable for the damages caused by the use of incorrect data, or of third parties, regardless of the existence of guilt.

4.5. Mundial is not responsible for the veracity of the information provided by its USERS, being entirely responsible for its content.

4.6. Mundial can check the veracity of the registration data of a USER at any time. In case of incorrect or untruthful data, or in case the USER refuses to send the required documents, Mundial will be able to block the USER's profile until the irregularity is corrected.

4.7. The USER will access his/her account through login and password, being committed not to inform third parties of these data, and being fully responsible for the use that is made of them.

4.8. We provide the option to register and access our sites with your Facebook login. In this case, certain Personal Data may be shared with this third party. You can always decide whether or not to integrate this information.

4.9. We do not control the policies and practices of any other websites or third-party mechanisms.

4.10. The USER undertakes to notify Mundial immediately, by means of communication in which receipt by Mundial is certified, of any unauthorized use of his/her account, as well as unauthorized access by third parties to the same. The USER will be the only responsible for the operations performed in his/her account since access to it will only be possible through the USER's personal password.

4.11. When registering, the user declares to be fully aware of this document and, likewise, of the Privacy Policy, available at the bottom of the Portal, because the allegation of lack of knowledge shall not exempt the user from occasional responsibilities during the use of the Portal.

4.12. Whenever it is convenient, the USER may change his/her password and some of his/her registration data by means of a proper resource of the Portal.

4.13. However, access to certain functionalities depends on specific information, marked and indicated on the registration page itself and according to its navigation.


5. PRIVACY AND PROTECTION OF PERSONAL DATA


5.1. Mundial has its own documents, called Privacy Policy and Cookies Policy, which regulate the treatment of personal data, including those collected at Mundial sites, being an integral and inseparable part of these Terms of Use and can be accessed in the Privacy Center located on the bottom left side of the Mundial web pages.


6. DISCLAIMERS AND LIMITATIONS OF LIABILITY


6.1 Without prejudice to the other provisions of the Terms of Use, Mundial is not responsible

For the improper use of the information, instruments, and/or materials made available on the sites, for any purpose, made by the USER, being the USER's entire responsibility for any eventual injury to his/her own right or to third parties, caused by this improper use;

For any problems or improper functioning that occur in the devices and equipment of the USER, that are not related to the use of the sites;

For any direct or indirect damage caused by third-party events, such as, but not limited to, hacker attacks, system, server, or internet connection failures, including the actions of software that may damage your physical or logical assets (for example, viruses and malware) as a result of access, use or browsing on the sites, as well as the transfer of data, files, images, text or videos contained on the sites; and

7. GENERAL PROVISIONS

 

7.1. The Terms of Use are subject to constant improvement and refinement. Thus, Mundial reserves the right to modify them at any time, according to their purpose or convenience, being up to the USER to verify it every time he/she accesses the site.

 

7.2 Tolerance of the eventual non-fulfillment of any conditions of these Terms of Use will not constitute a waiver or novation, nor will prevent Mundial from demanding these conditions at any time.

Mundial is based in Brazil, however, we may subcontract to companies located or that process personal data in other countries.
